Hi! We know privacy policies aren’t exactly beach-reads, so we’ve written this one to be clear and practical. It explains what we collect, why we collect it, how we use it, who we share it with, your choices, and your rights. If anything here isn’t clear, please reach out.

Where this Policy applies

This Policy applies to websites, apps, events, and features we operate under the Vibely brand (collectively, the “Service”). If a feature has its own privacy notice, that notice controls for that feature.

Some data is provided by you, some is created when you use the Service, and some comes from third parties (only where lawful and with your permission when required).

We’ll clearly prompt for permissions and you can withdraw them at any time in your device and app settings. Certain features may stop working without these permissions.

How we use your data (Purposes + Legal bases)

We process data to provide and improve the Service, promote safety, run our business, and meet legal obligations.

Core Service & features (create/maintain account and profile; match & recommend; communications; sweepstakes/events; customer support; uptime, debugging):

  • Legal bases: contract performance; legitimate interests; consent for sensitive/special data and certain device permissions.

Payments and subscriptions (process payments; manage renewals; pricing/promotions):

  • Legal bases: contract performance; legitimate interests; legal obligations (tax/records).

Personalization, analytics & product improvement (A/B tests; surveys; model training to make recommendations more relevant; quality assurance):

Safety, integrity & security (detect/prevent spam, fraud, abuse; enforce rules; verify identity; protect our users on and off-platform where permitted):

Marketing & advertising (our own communications; measuring effectiveness; interest-based ads on and off Vibely):

Compliance & legal (regulatory requests; disputes; defending rights; tax/accounting; recordkeeping):

  • Legal bases: legal obligations; legitimate interests; establishment/exercise/defense of legal claims; vital interests.

Automated decisions/profiling. We use algorithms to help rank and recommend profiles and detect spam/fraud. You can contact us to request information about these systems, to contest certain automated decisions, or to seek human review where required by law.

How we share data

We never sell your personal data in the common-sense meaning of “sell.” We share data in these situations:

  • With other members: Content you post on your profile (and what you send in chats to those recipients). If someone reports an issue, we may tell them the result (when appropriate).

  • Service providers (processors): Hosting, analytics, customer support, moderation, security, notifications, payment processing, ID and selfie verification, advertising and measurement. They must follow our instructions and protect your data.

  • Advertising & measurement partners: We may allow partners to set cookies/SDKs or receive pseudonymous identifiers (e.g., hashed email, ad IDs) to measure campaigns and show more relevant ads. You can manage preferences in Settings → Privacy and your device settings. In some U.S. states this can be deemed “share,” “sell,” or “targeted advertising”—see Section 8 and the California Notice.

  • Affiliates (“Vibely Group”): For safety (e.g., blocking known bad actors), platform operations, consolidated reporting, or limited cross-platform features where offered (we’ll ask where required).

  • Law enforcement / legal: When required by law or to protect users, our company, or the public.

Corporate transactions: If we undergo a merger, acquisition, or reorganization, your data may transfer consistent with this Policy.

How Vibely companies work together

To keep users safe and deliver/improve features, Vibely entities and affiliates may share limited data (e.g., safety signals, banned-user markers, platform operations support). If we ever enable cross-app discovery or features, we’ll notify you and seek consent where required.

Cross-border data transfers

We operate globally. Your data may be processed in countries outside your own, including Australia, the EU/UK, the U.S. and others with different laws. Where required, we use appropriate safeguards (e.g., EU Standard Contractual Clauses, UK IDTA/Addendum) and conduct transfer risk assessments. Copies of relevant SCCs can be requested (we may redact proprietary terms).

Your choices and rights

Your options live in Settings → Privacy (in-app) and your device settings (permissions, ads). Depending on where you live, you may have some or all of these rights:

  • Access & Portability – get a copy of your data.

  • Correction – fix inaccurate or incomplete data.

  • Deletion – delete your account or request erasure (we’ll keep limited data as allowed/required—see Retention).

  • Restriction / Objection – ask us to pause or limit certain processing; opt out of direct marketing at any time.

  • Consent withdrawal – revoke permission you previously gave (e.g., precise location, face geometry).

  • Opt-out of targeted ads / “sale” / “sharing” (US states) – use Your Privacy Choices in our website footer/app settings and device ad settings. Authorized agents may submit requests where permitted.

  • EU/UK/EEA – you may lodge a complaint with your local data protection authority.

  • Australia – you may complain to the OAIC (Office of the Australian Information Commissioner) if you’re unsatisfied with our response.

  • Verification: We may ask for information to verify your identity before completing your request.

Contact for rights requests: social@vibely.com.au (or use in-app tools). If we decline a request, we’ll explain why where legally required. Certain U.S. states allow you to appeal our response—reply to our decision with “Privacy Request Appeal.”

How long we keep your data (retention)

We retain personal data only as long as needed for the purposes in this Policy and to comply with law.

  • Account closure: When you delete your account, your profile is no longer visible. We generally delete or anonymize personal data after closure, subject to:

    • Safety window: We retain limited data for a short period (e.g., ~3 months) to investigate safety issues and prevent re-registration by banned users (longer where the law or investigations require).

    • Legal/business records: Transaction records (e.g., tax) may be kept up to 10 years (jurisdiction-dependent). Logs may be kept for a limited period to ensure security and integrity.

    • Disputes/compliance: We may preserve data if reasonably needed for audits, legal claims, or law enforcement requests.

We may keep aggregated or de-identified data that cannot reasonably identify you.

Vibely is 18+ only. If you believe someone under 18 is using Vibely, report it in-app or email social@vibely.com.au

Changes to this Policy

We update this Policy from time to time. If changes are material, we’ll notify you (e.g., email, app notice) before they take effect so you can review them.

California Privacy Notice (supplement)

If you’re a California resident, this section explains how we handle “personal information” under the CCPA/CPRA:

  • Categories collected: Identifiers (e.g., contact info, ad IDs), commercial info (purchases), internet/usage data, geolocation, inferences, and—only if you provide/consent—sensitive personal information (e.g., sexual orientation) and biometric templates for Selfie Verification.

  • Sources: You, your devices, our processors/partners, optional third-party logins.

  • Purposes: See Section 4.

  • Disclosures: To service providers, advertising/measurement partners (which may be deemed “sharing”/“selling” under CCPA), affiliates, and legal recipients. We do not knowingly sell the personal information of minors.

  • Sensitive personal information: Used only for the limited purposes allowed by law (e.g., to provide the service, security/integrity, short-term transient use) or with your consent.

Your rights: Know/access, correct, delete, portability, opt-out of sale/sharing/targeted ads, limit use/disclosure of sensitive PI (where applicable), and non-discrimination. Use Your Privacy Choices in the app/footer or email social@vibely.com.au You may use an authorized agent.

Consumer Health Data Privacy Notice (Washington & Nevada) (supplement)

For residents of Washington (My Health My Data Act) and Nevada (Consumer Health Data Law): if features involve Consumer Health Data (e.g., wellness tags you choose to add), we will:

  • Collect, use, and share such data only for the purposes you’re told about (and with consent where required).

  • Provide access/deletion/appeal rights consistent with law.

  • Obtain separate consent for sale or geofencing (we don’t sell CHD and we don’t use geofencing near sensitive locations).

Cookies, SDKs, and similar tech

We use cookies/SDKs for essential operations, analytics, personalization, and, with consent where required, advertising. Manage preferences in Settings → Privacy, your browser, and device ad settings.

Security

We implement administrative, technical, and physical safeguards appropriate to the nature of the data, including encryption in transit, access controls, and secure development practices. No system is 100% secure—please keep your account credentials safe.
